Gardeners Canary Wharf Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Canary Wharf provides gardening and related services to residential and commercial clients. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Client means the individual, business or organisation booking or receiving the services.

Company means Gardeners Canary Wharf, the provider of the services.

Services means any gardening, garden maintenance, lawn care, hedge trimming, planting, soft landscaping, garden tidy up, green waste removal or related work supplied by the Company.

Service Area means the areas in and around Canary Wharf and surrounding London districts where the Company operates from time to time.

Booking means a confirmed request for Services made by the Client and accepted by the Company.

2. Scope of Services

The Company provides a range of gardening and outdoor maintenance services in the Service Area. The precise scope of work for each Booking will be agreed in advance, usually by reference to a quotation or service description communicated to the Client.

Any additional or varied services requested by the Client during or after commencement of the work may incur extra charges, which will be discussed and agreed before proceeding wherever reasonably possible.

The Company reserves the right to refuse work which is unsafe, unlawful, outside its expertise or not reasonably practicable, including but not limited to work at unsafe heights, work involving hazardous materials, or work that may cause damage to property or utilities.

3. Booking Process

3.1 Booking request

Clients may request a Booking by contacting the Company and providing accurate information about the property, garden layout, access arrangements, and the type of Services required.

3.2 Quotations

Where appropriate, the Company may provide a quotation for the Services. Quotations are usually based on the information supplied by the Client and may be subject to change if the actual conditions on site differ materially from those described.

Unless stated otherwise, quotations are valid for 30 days from the date of issue. Acceptance of a quotation by the Client constitutes an offer to purchase the Services on these Terms and Conditions.

3.3 Confirmation of booking

A Booking is confirmed when the Company expressly accepts the Client’s request, either verbally or in writing, and allocates a date and time for the Services. The Company may, at its discretion, require a deposit or prepayment as a condition of confirming a Booking.

3.4 Changes to bookings

Any requested changes to the scope, date or time of a Booking must be agreed with the Company in advance and may be subject to availability and revised pricing. The Company will use reasonable efforts to accommodate changes but cannot guarantee that all requests can be met.

4. Access and Client Obligations

The Client must ensure that the Company’s operatives have safe and reasonable access to the garden and any areas where the Services are to be carried out.

The Client is responsible for:

Ensuring gates, doors and access points are unlocked or that someone is present to provide access at the agreed time.

Informing the Company in advance of any specific access restrictions, parking limitations, security systems or local regulations that may affect the Services.

Identifying and clearly marking any underground services, pipes, cables, irrigation systems or other concealed features that could be damaged during normal gardening activities.

Securing pets, children and vulnerable individuals away from the work area for the duration of the Services.

If access is not available at the agreed time, or if the Company is unable to carry out the Services due to Client default, the Company may charge a call-out or cancellation fee as set out in these Terms and Conditions.

5. Pricing and Payments

5.1 Prices

Prices for the Services will be communicated to the Client before the Booking is confirmed, either on an hourly basis, fixed fee, or as part of a regular maintenance plan. All prices are quoted in pounds sterling and, unless explicitly stated, are inclusive of standard labour and use of equipment.

Additional charges may apply for green waste removal, specialist materials, disposal fees, parking costs, congestion or emission zone charges, and any other third-party charges reasonably incurred in the provision of the Services.

5.2 Payment terms

Unless otherwise agreed, payment is due upon completion of the Services for one-off jobs, or in accordance with an agreed schedule for ongoing maintenance contracts.

The Company accepts various forms of payment as notified to the Client from time to time. Cash payments, where accepted, must be made directly to authorised Company personnel and will be receipted.

5.3 Deposits

The Company may request a deposit for larger projects, materials-heavy work, or at its discretion. Deposits are generally non-refundable except where the Company cancels the Booking or fails to provide the Services, subject to the terms below.

5.4 Late payment

If payment is not received by the due date, the Company reserves the right to charge interest on the overdue amount and to recover any reasonable costs incurred in pursuing payment. The Company may also suspend or cancel further Services until all outstanding sums are paid.

6. Cancellations and Rescheduling

6.1 Client cancellations

The Client may cancel or reschedule a Booking by giving reasonable notice to the Company.

For standard gardening visits, if less than 24 hours notice is given, the Company may charge a cancellation fee of up to 50 percent of the quoted price for the Booking.

For larger projects or full-day bookings, the Company may require a longer notice period, which will be confirmed at the time of booking. Failure to provide the required notice may result in forfeiture of any deposit and a cancellation charge reflecting the time reserved.

6.2 Company cancellations

The Company reserves the right to cancel or reschedule a Booking due to adverse weather conditions, staff illness, equipment failure, safety concerns, or other circumstances beyond its reasonable control.

Where the Company cancels a Booking, it will use reasonable efforts to offer an alternative date and time that is acceptable to the Client. If this is not possible, any deposit or prepayment for the cancelled Booking will be refunded.

6.3 Weather and safety

Some Services may not be safe or practical in severe or unsuitable weather conditions. The Company has sole discretion to decide whether conditions allow the work to proceed. In such cases, the Company will seek to reschedule the Booking at the earliest convenient time.

7. Materials and Plants

Where the Company supplies plants, turf, soil, mulch, aggregates or other materials, it will use reasonable care to source products of suitable quality for the intended purpose.

The Client acknowledges that living plants are naturally variable and subject to conditions such as soil, weather, pests and ongoing maintenance. The Company cannot guarantee the survival, growth rate or long-term performance of plants once they have been installed and handed over to the Client.

Ownership of materials supplied by the Company passes to the Client once full payment has been received. Until then, the Company retains title to the materials, although risk of loss or damage passes to the Client on delivery to the site.

8. Waste Regulations and Disposal

The Company complies with applicable waste management and environmental regulations when carrying out gardening services in the Service Area.

Unless otherwise agreed, the standard service does not include the removal of green waste, soil, rubble or general rubbish. Where waste removal is requested or included:

The Company will remove only the waste generated by its own operations and not household rubbish or pre-existing waste, unless specifically agreed.

Green waste and other materials will be transported and disposed of at suitable facilities in accordance with local regulations.

Additional charges may apply for the collection, transportation and disposal of waste, especially for large volumes, heavy materials or mixed waste that incurs higher disposal fees.

Clients may choose to retain green waste on site for composting or other purposes. In such cases, the Client is responsible for storage, use and any regulatory compliance related to that waste.

9. Liability and Insurance

The Company will exercise reasonable skill and care in providing the Services. However, the Client accepts that gardening work involves the use of tools, machinery and physical activity that carry inherent risks.

9.1 Damage to property

The Company will take reasonable precautions to avoid damage to property, including lawns, plants, structures, paths and neighbouring areas. The Client must notify the Company promptly of any alleged damage caused by the Services.

The Company is not liable for damage resulting from pre-existing defects, wear and tear, hidden obstructions, unstable structures, concealed utilities, or conditions that could not reasonably have been foreseen.

9.2 Exclusions and limitations

To the fullest extent permitted by law, the Company is not liable for:

Any indirect or consequential loss, including loss of enjoyment, loss of use, or loss of profit.

Losses arising from factors beyond its reasonable control, including extreme weather, pests, plant diseases or acts of third parties.

Minor or cosmetic damage that does not materially affect the use of the property.

The Company’s total liability for any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, is limited to the total fees paid or payable by the Client for the specific Booking to which the claim relates.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Health and Safety

The Company operates in accordance with relevant health and safety legislation when working in gardens, communal grounds and outdoor spaces within the Service Area.

The Client agrees not to interfere with the work of the Company’s staff or to use Company tools or machinery. Clients and any persons present on site must follow reasonable instructions from the Company’s personnel relating to safety and access to the work area.

11. Complaints and Service Quality

The Company aims to provide a reliable and professional gardening service. If the Client is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, ideally within 48 hours of completion.

The Company will investigate any reasonable complaint and, where appropriate, may offer to rectify the issue, provide advice on further steps, or agree an alternative remedy. Any remedial work will be carried out at the Company’s discretion and subject to the nature of the complaint.

12. Data Protection and Privacy

The Company may collect and store personal information about Clients, such as names, addresses, service details and payment information, for the purpose of managing bookings, providing Services and maintaining records.

The Company will take reasonable steps to keep such information secure and will not sell or share it with unrelated third parties except as required by law or for legitimate business purposes such as accounting, payment processing or debt recovery.

13. Variation of Terms

The Company may update or amend these Terms and Conditions from time to time. The current version will apply to all new Bookings at the time they are made. For ongoing maintenance contracts, the Company will notify the Client of any material changes in advance where reasonably practicable.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of gardening services by the Company in the Service Area.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be severed from the remaining terms, which shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with any written quotation or service agreement issued by the Company and accepted by the Client, constitute the entire agreement between the parties in relation to the Services and supersede all previous discussions, correspondence or understandings.
